Terms and Conditions

Crucial Recycling Ltd

These Terms and Conditions govern the provision of rubbish removal, clearance, and waste management services provided by Crucial Recycling Ltd (“the Company”, “we”, “us”, or “our”) to residential and commercial clients (“the Customer”, “you”, or “your”).

1. Services & Booking

  • Service Scope: We offer domestic and commercial waste collection, house/site clearance, bulky waste removal, and related waste management services.
  • Estimates & Quotations: Quotations provided remotely (via phone, WhatsApp, photos, or email) are initial estimates based on customer descriptions. Final pricing is verified upon arrival at the collection site based on actual volume, weight, labor required, and waste type.
  • Right to Refuse: The Company reserves the right to decline or re-quote for any load that exceeds the original description or contains unmentioned hazardous materials.

2. Waste Types & Prohibited Materials

  • Standard Acceptable Waste: General non-hazardous household waste, office furniture, dry commercial waste, garden waste, and general mixed builder’s waste (subject to agreed weight limits).
  • Permitted Restricted Waste (Requires Prior Notice): Certain items incur additional processing or environmental charges and must be declared prior to booking. These include, but are not limited to:

    • Mattresses
    • Refrigerators, freezers, and air-conditioning units (WEEE items)
    • Televisions, computer monitors, and electronic equipment
    • Vehicle tires
  • Prohibited Hazardous Waste: Crucial Recycling Ltd does not accept hazardous materials unless specifically pre-arranged with appropriate licensing. Prohibited items include:

    • Asbestos or materials containing asbestos
    • Gas cylinders, fire extinguishers, or pressurized containers
    • Toxic, chemical, corrosive, or flammable liquids/solvents
    • Medical, biological, or clinical waste
    • Car batteries, oils, or fuel residues
  • Customer Indemnity: The Customer indemnifies Crucial Recycling Ltd against any fines, disposal fees, or legal costs incurred if undisclosed prohibited/hazardous waste is mixed into the load.

3. Service Delivery & Site Access

  • Access Requirements: The Customer must ensure safe, clear, and unhindered access to the waste on the agreed date and time window.
  • Parking & Permits: The Customer is responsible for ensuring adequate parking near the premises. Any parking fees, council permits, or parking fines incurred due to lack of adequate arrangements will be charged to the Customer.
  • Property Access: Unless specifically agreed under a clearance service, items must be accessible on ground floor level or at agreed collection points.
  • Unattended Collections: If waste is left outside for collection while the Customer is off-site, the Company accepts no liability for items removed that were not intended for disposal if they were placed in or directly adjacent to the designated waste area.

4. Deposits, Pricing & Payments

  • Booking Deposits: A booking fee or deposit may be required to reserve a collection slot. Any deposit paid will be deducted from the final invoice.
  • Cancellation & Rescheduling:

    • Cancellations made with 24 hours or more notice will receive partial refund of any deposit paid.
    • Cancellations made with less than 24 hours’ notice may result in forfeiture of the deposit to cover administrative and routing costs.
  • Failed Collections / Call-Out Charges: If our team arrives and is unable to gain access, or if the collection cannot proceed through no fault of the Company, a call-out fee (or retention of the deposit) will apply.
  • Payment Terms: Settlement of the remaining balance is due immediately upon completion of the service. Payment can be made via cash, credit/debit card, bank transfer, or approved third-party finance providers (e.g., Klarna, where offered).

5. Waste Duty of Care & Environmental Compliance

  • Legal Transfer: Ownership and legal responsibility for the waste transfers to Crucial Recycling Ltd once the waste has been loaded onto our vehicles and payment has been processed.
  • Environmental Regulations: All waste collected will be handled, transported, and recycled or disposed of in accordance with the Environmental Protection Act 1990 and applicable UK waste regulations.
  • Waste Transfer Notes (WTN): A Waste Transfer Note or receipt can be provided upon request for commercial or regulatory compliance purposes.

6. Limitation of Liability

  • Property Protection: Our staff will exercise reasonable care during property clearances and waste removal. However, the Company accepts no liability for pre-existing structural flaws, accidental superficial scuffs, or minor damage in narrow or restricted access spaces unless caused by direct negligence.
  • Driveways & Surfaces: Drivers will not enter private driveways, footpaths, or unpaved areas if there is a risk of surface damage unless requested by the Customer. The Customer assumes responsibility for damage to driveways, underground services, or flagstones caused by vehicle weight when access is explicitly requested.
  • Indirect / Consequential Loss: Crucial Recycling Ltd shall not be liable for indirect, financial, or consequential losses resulting from delayed collections due to traffic, severe weather, mechanical breakdown, or events beyond our reasonable control.
  • Statutory Rights: Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, or any rights guaranteed under UK consumer law.
